AND SO I WANTED TO HIGHLIGHT THE IMPORTANCE OF NOT ONLY THE FOUNDATION AND THE GREAT WORK THAT THEY'RE DOING, BUT ALSO THESE YOUNG LADIES THAT ARE MAKING A HUGE EFFORT WHEN IT COMES TO PURSUING HIGHER EDUCATION, GETTING MENTORSHIP, WHICH IS REALLY IMPORTANT SOMETIMES SEEKING THAT. AND JUST BEING PART OF A COMMUNITY. SO IT WAS STARTED BACK IN THE PLANNING STAGES BACK IN THE SPRING OF 2011, WAS APPROVED BY THE CITY COUNCIL IN NOVEMBER OF 13, AND THE DEVELOPMENT AGREEMENT WAS APPROVED IN NOVEMBER OF I'M SORRY, IN JUNE OF 2014. SO THE DEVELOPMENT AGREEMENT TRAILED THE ACTUAL APPROVAL OF THE SPECIFIC PLAN. SO I'M GOING TO GIVE YOU KIND OF AN OVERVIEW OF THE SPECIFIC PLAN PROJECT. I'M GOING TO COMPARE THE ORIGINAL DEVELOPMENT AGREEMENT WITH THE FIRST AMENDMENT AND THE PROPOSAL BEFORE YOU TONIGHT, WHICH IS THE AMENDED AND RESTATED DEVELOPMENT AGREEMENT. AND THEN LASTLY, I'M GOING TO GIVE YOU THE RECOMMENDATION OF THE PLANNING COMMISSION AND STAFF. SO JUST TO SUMMARIZE, THE PROJECT IS LOCATED ON 2200 ACRES. IT'S IN THE EASTERN END OF THE CITY. IT IS ON THE SOUTH SIDE OF INTERSTATE TEN. IT IS NORTH OF AVENUE 52. IT IS EAST OF THE ALL-AMERICAN CANAL. AGAIN, THE AREA IN THE KIND OF RIGHT HAND SQUARE WAS AN AREA ABOUT 640 ACRES. IT WAS ANNEXED INTO THE CITY IN 2014, SO ORIGINALLY THAT WAS NOT PART OF THE SPECIFIC PLAN CITY. I SHOULD SAY IT WAS PART OF THE SPECIFIC PLAN. SO AGAIN, IT WAS APPROVED IN NOVEMBER OF 2013 AND THE ORIGINAL DEVELOPMENT AGREEMENT BECAME EFFECTIVE ON JULY 25TH, 2014. THE SPECIFIC PLAN CONTAINED 7800 UNITS OF VARYING DENSITIES, RANGING FROM TWO TO THE ACRE TO 25 UNITS TO THE ACRE. YOU CAN SEE THE SPECIFIC PLAN PROPOSED THE ACCESS ON AVENUE 50 CROSSING THE CANAL, AND ALSO ON AVENUE 52. THAT WAS THE TRANSIT LOCATIONS FOR PHASES ONE THROUGH FOUR OF THE PROJECT. THE PROJECT WAS CONDITIONED THAT ANYTHING THAT WAS CONTAINED IN PHASE FIVE HAD TO HAVE THE INTERCHANGE AT I-10 AND AVENUE 50 CONSTRUCTED AND OPERATIONAL.
THE PROJECT ALSO HAD THREE ELEMENTARY SCHOOL SITES AND ONE MIDDLE SCHOOL. WITHIN THE PROJECT BOUNDARIES HAD A NUMBER OF OPEN SPACE AREAS THAT WERE PRESENT. YOU CAN SEE ON THE LEFT HAND CORNER OF THE PROJECT SITE, THERE'S A LOT OF GREEN GOING THROUGH THERE. THAT'S THE SAN ANDREAS FAULT. IT GOES IN, TRAVERSES THE SITE KIND OF AT AN ANGLE AS IT GOES DOWN THROUGH THE PROJECT SITE AND ALL THAT IS OPEN SPACE. THE PLANS WERE FOR THAT ONE GREEN AREA UP THERE TO BE 175 ACRE PARK, AND THEN OTHER OPEN SPACE AREAS ALONG THE FAULT AS WELL. THERE'S SOME SIGNIFICANT DRAINAGE THAT GOES THROUGH THE PROJECT SITE COMING FROM THE NORTH OF I-10 AND COMING FROM THE HILLS KIND OF TO THE EAST OF THE PROJECT SITE. AND ALL THOSE WERE TAKEN INTO CONSIDERATION WHEN THE PROJECT WAS APPROVED AND THE PROJECT AGAIN CONDITIONED SIGNIFICANTLY IN TERMS OF EARTHQUAKE FAULTING, FLOODING, TRANSPORTATION, A NUMBER OF MAJOR ISSUES THAT WERE BASICALLY LED TO THIS SPECIFIC PLAN. LAND USE. THIS IS THE TABLE THAT THE SPECIFIC PLAN CONTAINS IN TERMS OF THE LAND USES, AGAIN, 7200 UNITS, SINGLE FAMILY AND MULTIPLE FAMILY, ONE POINT 5,000,000FTā !S OF RETAIL OFFICE SPACE, THREE ELEMENTARY SCHOOLS, ONE MIDDLE SCHOOL, APPROXIMATELY 344 ACRES OF PARKS, 557 ACRES OF OPEN SPACE, AND 112 ACRES OF ROADWAYS. THERE WERE THREE VILLAGES PROPOSED WITHIN THE PROJECT ON THE NORTH SIDE THE GATEWAY VILLAGE IN THE MIDDLE OF THE PROJECT, THE CENTRAL VILLAGE AND THEN THE MORE HILLY AREAS. KIND OF ON THE SOUTH SIDE WAS THE HILLSIDE VILLAGE. ONE OF THE BEST ATTRIBUTES I THOUGHT WITH THIS PROJECT WAS 100 FOOT PASEO THAT CONNECTED ALL THE VILLAGES TOGETHER SO THAT YOU COULD GET FROM ONE VILLAGE TO ANOTHER VILLAGE WITHOUT GOING ON A STREET. IT WAS PLANNED THAT YOU COULD GO ON THIS PASEO THAT TOOK YOU THROUGH THE SCHOOLS, THROUGH THE PARKS, AND CONNECTED ALL THE ENTIRE PROJECT TOGETHER. THE PROJECT WAS ENVISIONED TO HAVE FIVE PHASES. THERE WERE NO LEGAL CHALLENGES MADE FOLLOWING APPROVAL OF THE SPECIFIC PLAN, AND WE FILED THE NOTICE OF DETERMINATION AND THE PROJECT HAS BEEN AVAILABLE FOR DEVELOPMENT EVER SINCE. ONE OF THE ITEMS AGAIN WE'RE GOING TO DISCUSS THIS EVENING IS DEVELOPMENT AGREEMENTS. THESE ARE SOMETHING THAT ARE DISCRETIONARY WITHIN THE STATE OF CALIFORNIA. CITIES AND COUNTIES HAVE A LOT OF ABILITY TO NEGOTIATE CONDITIONS, TERMS, RESTRICTIONS, REQUIREMENTS FOR SUBSEQUENT DISCRETIONARY ACTIONS WITHIN THE DEVELOPMENT AGREEMENT. BASICALLY, IT'S A NEGOTIATION, AN AGREEMENT BETWEEN THE DEVELOPER AND THE CITY. SO THE ORIGINAL LAW AND THE DEVELOPMENT AGREEMENT WAS AGAIN APPROVED IN JUNE OF 2014, EFFECTIVE ON JULY 25TH, 2014. I LISTED SOME OF THE MOST IMPORTANT ASPECTS OF THE DEVELOPMENT AGREEMENT. SO IT WAS EFFECTIVE JULY 25TH, 2014. IT WAS HAD A TERM OF 15 YEARS WITH THREE FIVE YEAR EXTENSIONS.THERE WAS A DA FEE OF $2,500 PER DWELLING UNIT PAID UPON OCCUPANCY PERMIT. IT FROZE DIFF FEES FOR THE FIRST 2000 UNITS, AND THERE WERE A NUMBER OF CONSTRUCTION MILESTONES THAT WERE WITHIN THE DEVELOPMENT AGREEMENT BASICALLY REQUIRED THAT CONSTRUCTION BEGAN WITHIN FIVE YEARS OR BY JULY 25TH, 2019, THAT 800 OCCUPANCY PERMITS BE ISSUED WITHIN TEN YEARS, THAT 50,000FTā !S OF COMMERCIAL BE CONSTRUCTED AND OCCUPIED WITHIN 15 YEARS AT 140 HOTEL ROOMS, BE READY FOR OCCUPANCY WITHIN 20 YEARS. ONE OF THE OTHER IMPORTANT ITEMS WAS THE FIRE STATION. THERE WAS A FIRE STATION PLANNED IN THAT SPECIFIC PLAN AREA, AND THE FIRE DEPARTMENT REQUIRED A SEPARATE DEVELOPMENT AGREEMENT AND BOND BE POSTED PRIOR TO THE ISSUANCE OF THE FIRST BUILDING PERMIT. THERE WAS ALSO CONDITIONS AND NEGOTIATIONS REGARDING CFDS, AND THAT THEY HAD TO FORM A CFD WITHIN THE SUBMITTAL OF THE FIRST BUILDERS MAP, AND THAT PARKS FIRE IN GENERAL GOVERNMENT FEE WERE DEEMED FULLY SATISFIED BECAUSE THE DEVELOPER WAS GOING TO BUILD THE PARKS AND PROVIDE MONEY TO THE CITY, AND ALSO HAVE A SEPARATE AGREEMENT WITH FIRE ON CONSTRUCTION OF THE STATION. AND THEN AGAIN AVENUE 50 EXTENSION INTERCHANGE. THE CITY AND LANDOWNER WERE WORKING TOGETHER TO SECURE FUNDING FOR THAT. IT WAS ENVISIONED BACK IN 2013 AND 14 THAT THE INTERCHANGE WOULD BE CONSTRUCTED AND OPERATIONAL IN 2017. OBVIOUSLY, THAT DID NOT HAPPEN. SO WHAT HAPPENED IN TERMS OF AFTER THE SPECIFIC PLAN DEVELOPMENT AGREEMENT WERE APPROVED, THE APPLICANT STARTED WORKING ON THE PLANS FOR AVENUE 50, PLANS FOR CROSSING THE TWO CANALS AT AVENUE 50 AND 52, AND IT TOOK LONGER THAN THEY ENVISIONED. SO WHAT HAPPENED IS IN 2019, IT BECAME APPARENT THAT THE LANDOWNER WAS NOT GOING TO MEET THE FIRST MILESTONE OF CONSTRUCTING SOMETHING ON THE PROJECT WITHIN FIVE YEARS, WHICH WOULD HAVE BEEN JULY 25TH OF 2019. SO THEY SUBMITTED AN AMENDMENT TO THE DEVELOPMENT AGREEMENT. IN 2019. IT WAS APPROVED BY THE CITY IN 2020, AND THE CITY CHANGED A FEW THINGS IN TERMS OF WHAT THE DEVELOPMENT AGREEMENT STATED. THOSE ARE KIND OF THE HIGHLIGHTS OF WHAT HAPPENED ON THE FIRST AMENDMENT. AGAIN, IT WAS APPROVED IN 2020. AND THE APPLICANT AT THAT POINT, I SHOULD SAY THAT THE APPLICANT WAS A FIRM CALLED LIGHTSTONE. THE ACTUAL AGREEMENT WAS WITH AN ENTITY CALLED PSA. THEY'RE FROM NEW JERSEY, AND THEY HAD A FIRM CALLED NEW WEST COMMUNITIES WORKING ON THIS, WHO WAS A FIRM OUT OF LAS VEGAS. AND SO THEY STARTED WORKING A LITTLE BIT HARDER ON THE AVENUE 50 CORRIDOR. THERE WAS SOME PROCEEDINGS WITH EMINENT DOMAIN THAT NEEDED TO HAPPEN FOR THE CANAL CROSSINGS. THEY BEGAN ENGINEERING OF THE AVENUE 50 CROSSINGS, AND THAT WAS AFTER THE FIRST AGREEMENT WAS APPROVED. AND THEN THINGS KIND OF CAME TO A CLOSE. THE LIGHTSTONE GROUP DECIDED THIS WAS NOT THEIR PRIORITY. THEY'RE A LARGE COMPANY WITH A LOT OF COMMERCIAL AND MULTIFAMILY UNITS ON THE EAST COAST IN THE MIDWEST, AND THIS JUST HAPPENED TO BE NOT IN THEIR PORTFOLIO FOLLOWING THE 2020 AGREEMENT. AND SO THE PROPERTY BASICALLY SAT AND THERE WERE NO APPLICANTS THAT NO APPLICATIONS THAT WERE SUBMITTED TO THE CITY. FOLLOWING THE 2020 DEVELOPMENT AGREEMENT AMENDMENT IN 2023, A GROUP CALLED KPC THERE, BASED IN CORONA, THE HEAD OF KPC IS A DOCTOR, KALI CHAUDHRY, AND HE ENTERED INTO A PURCHASE AGREEMENT TO PURCHASE THE PROPERTY AND SUBMITTED AN AMENDED AND RESTATED DEVELOPMENT AGREEMENT IN JUNE OF 2023. FOR THE PAST TWO YEARS, WE'VE BEEN WORKING WITH THE KPC GROUP TO REACH CONSENSUS ON THE AMENDMENT OR THE RESTATED AND AMENDED DAR. AND WHAT'S BEFORE YOU THIS EVENING IS THAT AMENDED AND RESTATED AGREEMENT. I SHOULD ALSO SAY THAT FOR THE LAST 12 YEARS, THE PROJECT'S BEEN CALLED LA ENTRADA, AND RECENTLY THE APPLICANT HAS DECIDED THAT THEY'RE GOING TO CHANGE THE NAME TO CALIFORNIA CITY. AND THAT'S CALI CALI WITH A K. AND THAT, AGAIN, IS HIS FIRST NAME. HE LIKES THAT BRAND. HE'S BUILDING THE CALI HOTEL AT SOFI IN INGLEWOOD. SO THAT'S WHERE THE CALIFORNIA CITY CAME FROM. SO IN TERMS OF THE AMENDED AND RESTATED AGREEMENT, AGAIN, IT STARTS OUT WITH A NEW TERM. IT'S GOING TO BE A 30 YEAR TERM. IT'S GOT A 15 YEAR ORIGINAL TERM WITH THREE FIVE YEAR EXTENSIONS. IT WILL BRING THE EVENTUAL DATE TO 2055. AND THAT'S AN ADDITIONAL 11 YEARS FROM WHAT THE ORIGINAL DAR WAS ENVISIONING. WE DID NOT TIE THE COMMENCED CONSTRUCTION INTO BUILDING PERMITS OR YEARS. WE BASICALLY SAID IT DEPENDS ON WHEN THEY START CONSTRUCTION OF THE CANAL OR THE INTERCHANGE. AND SO THAT'S KIND OF A CHANGE WE MADE THERE. THE OCCUPANCY PERMITS WE HAD BEFORE 800. NOT APPLICABLE ANYMORE. WE DID TIE THAT THERE NEEDED TO BE 20,000FTā !S OF COMMERCIAL, AND E TIED IT WITHIN SEVEN YEARS OF THE INTERCHANGE BEING COMPLETED AND OPEN. THE SAME THING WITH THE 140 HOTEL ROOMS. AGAIN, WE TRIED TO MAKE IT SO THAT THE APPLICANT COULD START CONSTRUCTION ON THIS, GIVE THEM THE TIME THEY NEEDED TO SECURE FUNDING, GET THEIR PERMITS, GET THROUGH THE SYSTEM, AND ACTUALLY GET SOMETHING ON THE GROUND. THAT'S THE WHOLE INCENTIVE BEHIND THIS AMENDED AND RESTATED AGREEMENT IS TO ACTUALLY INCENTIVIZE THIS DEVELOPMENT TO GET IT OFF AND RUNNING. IT'S BEEN ON THE BOOKS FOR A NUMBER OF YEARS, AND THE CITY FELT THAT THEY REALLY NEEDED TO GET IT MOVING. AND SO WE ENCOURAGING THEM TO AGAIN START PROCESSING TENTATIVE MAPS AND GET THIS PROJECT ON THE ROAD TO CONSTRUCTION. ONE OF THE THINGS WE DID IS INSTEAD OF A DAR FEE THAT WAS INITIALLY OUT THE DOOR AT OCCUPANCY, WE'RE GIVING THEM A SLIDING SCALE. WE'RE SAYING, WE WANT YOU TO BUILD HOMES, AND WE'RE NOT GOING TO PUT A DAR FEE FOR THE FIRST 12 YEARS. SO IF YOU CAN BUILD 2000 HOMES WITHIN THE FIRST TWO YEARS, 12 YEARS, DO IT. WE WANT TO GIVE THEM AN OPPORTUNITY TO GET THIS PROJECT MOVING. AND THEN WE SAID, OKAY, AFTER THAT YEAR 13 THROUGH 16, I GET A FEE OF $2,500. AND THEN FOLLOWING THAT WE'RE GOING TO GET $5,000. AND THEN AFTER THAT WE'LL GET WHATEVER FEE IS IN EFFECT. AGAIN, THE WHOLE PURPOSE OF DOING THIS IS TO GET THIS PROJECT OFF THE GROUND. IT'S SOMETHING THE CITY REALLY WANTED TO SEE BACK IN 2013 AND 14 AND AGAIN 12 YEARS LATER. SAME THING. WE WANT THIS PROJECT TO SUCCEED. WE'VE CHANGED THE TRANSFER AND ASSIGNMENT FEE. IT WAS SIGNIFICANT IN TERMS OF WHAT IT WAS PROPOSING BEFORE. WE'RE SAYING NOW THE FEE IS BASED ON HOW MUCH TIME WE SPEND ON THAT ASSIGNMENT AND TRANSFER FEE. THEY NEEDED TO EXTEND THE DEVELOPMENT AGREEMENT, AND THEY NEGOTIATED SOMETHING THAT WASN'T FEASIBLE. SO WE CAME BACK AND MADE THIS MORE REASONABLE. IT DOESN'T PUT THE CITY IN A POSITION WHERE WE'RE LOSING ANYTHING. AND IN FACT, A LOT OF THOSE FEES WERE ONE TIME FEES.
IT WASN'T REOCCURRING FEES. SO A DEVELOPMENT AGREEMENT FEE IS ONE TIME WE COULD SPEND IT ON A PROJECT, SAY, OUTSIDE THE CITY, BUT IT DOESN'T HELP PAY FOR GENERAL FUND REOCCURRING EXPENSES. SO WITH WHAT THE PROGRESS WAS DONE WHEN JONATHAN HOY WAS HERE, ANDREW BEING HERE, WE FINISHED THE ALL OF THE AVENUE 50TH CORRIDOR OVER THE WHITEWATER, NOT THE WHITEWATER, BUT OVER THE ALL-AMERICAN CANAL. AND ALSO AT THE INTERCHANGE. THERE'S BEEN A LOT OF WORK THAT'S DONE. AND ALSO WE'VE GOTTEN THE RIGHT OF WAYS THAT WE'VE NEEDED. THERE'S A LOT OF WORK THAT HAS BEEN DONE, BUT IT JUST SAT. THIS IS IT WAS IT WAS A GREAT THING TO COME IN AND GET TO FINISH UP BECAUSE I'VE SEEN IT THE WHOLE WAY. I WAS HERE WHEN WE DID THE FIRST AGREEMENT, WHEN WE DID THE AMENDMENT, AND NOW TO SEE THIS THING THROUGH THE IMPORTANT THINGS THAT ARE IN PLACE FOR THE CITY. WE'RE GETTING OUR PARKS, WE'RE GETTING OUR FIRE STATION. THEY'RE GOING TO PAY US FOR SOME GOVERNMENTAL FACILITIES UP THERE AS WELL. THROUGH WE'RE GOING TO ISSUE BONDS. WE'RE GOING TO DO SOME BONDS UP THERE. WE'VE AGREED TO WORK WITH THEM ON THAT. WE'VE PUT IN TWO POINTS OF ACCESS. WE'RE THEN COME IN OVER 50TH AND THE ALL-AMERICAN CANAL AND 52 IN THE ALL-AMERICAN CANAL. AND 52 IS VERY IMPORTANT BECAUSE THAT'S WHERE THE INFRASTRUCTURE COMES IN FOR WATER AND SANITARY. WE'RE ALSO WORKING THROUGH THE RFP PROCESS TO BE ABLE TO GIVE THEM POWER AS WELL. THAT WAS SOMETHING THAT ELSE THAT WAS CONSIDERED. THIS IS A RESOLUTION DETERMINING THE AMOUNT OF PROPERTY TAX REVENUE TO BE EXCHANGED BETWEEN THE COUNTY AND THE CITY. REGARDING THE PROPOSED P7 MESQUITE ANNEXATION. THIS IS AN ANNEXATION CONSISTING OF ABOUT 375 ACRES LOCATED EAST OF JACKSON, SOUTH OF AVENUE 50, NORTH OF AVENUE 52, AND ON EITHER SIDE OF CALHOUN STREET. WE SUBMITTED THE APPLICATION TO LAFCO IN DECEMBER OF 24, AND WE ANTICIPATE A PUBLIC HEARING BEFORE LAFCO NEXT MONTH, MAY 22ND, 2025. THIS IS A PREREQUISITE TO THE LAFCO MEETING. IT'S REQUIRED BY THE CALIFORNIA REVENUE TAXATION COD. BECAUSE WE DON'T HAVE A MASTER AGREEMENT WITH THE COUNTY, WE HAD TO NEGOTIATE A SEPARATE AGREEMENT. AND THE PROPOSAL IS THAT WE WILL RECEIVE 25% OF ALL PROPERTY TAX REVENUE GENERATED WITHIN THE ANNEXATION AREA UNDER THE AD VALOREM TAX RATE FOR THE PROVISION OF GENERAL MUNICIPAL SERVICES, AND WE WILL RECEIVE 100% OF ALL PROPERTY TAX RATE GENERATED WITHIN THE ANNEXATION AREA FOR THE PREVENTION AND SUPPRESSION OF STRUCTURAL FIRES. WE HAD ALREADY SPENT A DECENT AMOUNT OF OUR SB ONE TREASURY MONIES ON A COUPLE RESIDENTIAL NEIGHBORHOODS, AND WE HAD ASKED FOR THIS FUNDING IN ORDER TO COMPLETE ONE OF OUR PRIMARY STREETS AS WELL. WE PUT THE PROJECT OUT TO BID ON MARCH 6TH, AND ON APRIL 8TH WE RECEIVED SEVEN BIDS, WHICH WAS FANTASTIC. WE DON'T NORMALLY GET THAT MANY BIDS, AND OUR LOWEST BID WAS ACTUALLY JUST UNDER $2 MILLION. YOU CAN SEE THE BIDS RANGED FROM THE 1.9 MILLION UP TO 3.4. SO WE'RE VERY HAPPY THAT THE BIDS CAME IN WELL UNDER WHAT OUR ANTICIPATED BUDGET WAS.
AVENUE 52. THE REASON THIS WAS A HIGH PRIORITY STREET. IT IS ONE OF OUR LOWEST RATED PRIMARY ARTERIAL STREETS, AS YOU CAN SEE IN THIS FROM OUR ATLAS PUBLIC VIEW, IT IS PRIMARILY RED. IT'S A MOSTLY FAILING, LOW QUALITY STREET. I DID PUT THE LINK UP THERE. THIS IS ALL FROM OUR ATLAS VIEW PUBLIC WEB PAGE, WHERE THE PUBLIC CAN GO AND THEY CAN SEE THE RATINGS OF ALL OF OUR STREETS. SO I JUST WANT TO KEEP ON ADVERTISING THAT AS SOMETHING THAT THE COMMUNITY CAN GO LOOK AT. WITHIN THE ATLAS VIEW, YOU CAN SEE THE QUALITY OF THE STREET. AND BECAUSE THE BIDS CAME IN BELOW BUDGET, WE ARE ALSO SEEKING TO DO THE SIDEWALK ON THE SOUTH SIDE OF THE STREET THAT WAS ORIGINALLY PART OF THE BUDGET, AND WE DID HAVE IT AS AN AD ALTERNATE, JUST IN CASE THE NUMBERS WERE HIGH. WE WANTED TO HAVE THAT OPTION TO MAKE SURE THAT WE COULD BE WITHIN BUDGET, BUT BECAUSE THE NUMBERS CAME IN SO FAVORABLE, WE DO WANT TO ADVANCE THAT MISSING LINK SIDEWALK AND THE DRIVEWAYS AS WELL. THERE WERE A COUPLE SHEETS THAT WHEN WE SCANNED IT, IT APPEARED THAT THEY WEREN'T WITH THE ORIGINAL DOCUMENT BECAUSE WHEN THEY HAVE THE NOTARIZED DOCUMENT, WHEN THEY NOTICE A DOCUMENT HAS KIND OF LIKE A RAISED TEXTURE TO IT, AND IT CAUSES THE PAGES TO GET STUCK WHEN WE SCANNED IT. SO THERE WAS NO MERIT TO THE BID PROTEST, IT WAS JUST BECAUSE WHEN WE SCANNED IT, A COUPLE PAGES GOT STUCK. BUT THEY DID SUBMIT EVERYTHING THAT WAS NEEDED AND EVERYTHING WAS RESPONSIVE. BID AND THEY DID NOT APPEAL THE DENIAL LETTER. THEIR TIMELINE FOR BEING ABLE TO APPEAL THE DENIAL OF THE BID PROTEST WAS YESTERDAY. SO THERE IS NO CURRENT VALID BID PROTEST THAT WOULD BE MOVING FORWARD. SO AS FAR AS THE FISCAL IMPACT, AS STATED, THERE IS NO ACTUAL FISCAL IMPACT FOR AWARDING THIS CONTRACT BECAUSE WE'VE ALREADY APPROPRIATED THE $3 MILLION TO THIS PROJECT. THE TOTAL ALL IN COST FOR THE PROJECT WITH MATERIALS TESTING CONTINGENCY, THE ENGINEERING FEES THAT WE'VE ALREADY SPENT COMES OUT TO ABOUT $2.2 MILLION, 2,246,006 AND $0.70, TO BE EXACT. SO THE STAFF RECOMMENDATION IS THAT WE AUTHORIZE THE CONSTRUCTION CONTRACT WITH ROVE ENGINEERING IN THE AMOUNT OF $1,996,097, AND ADD IN THE 10% CONTINGENCY. I ALSO JUST WANT TO COMMENT ON THE LIMITS. THE LIMITS ARE GOING TO BE FROM TYLER TO THE EDGE OF THE WEST EDGE OF THE WHITEWATER BRIDGE. THE REMAINING LITTLE BIT OF ASPHALT FROM THE EAST EDGE OF THE WHITEWATER BRIDGE TO THE HIGHWAY 86. THAT ASPHALT IS ALSO IN REALLY BAD SHAPE, BUT THAT IS ACTUALLY CALTRANS RIGHT OF WAY, NOT CITY RIGHT OF WAY. SO WE WILL BE TRYING TO WORK WITH CALTRANS AND PETITION THEM TO REPAIR THAT LAST LITTLE BIT. AS FAR AS MOVING FORWARD, SINCE WE DID APPROPRIATE $3 MILLION FOR STREET IMPROVEMENTS, THE CITY WOULD LIKE TO SEEK TO STILL SPEND THAT REMAINING $800,000 THAT WAS APPROPRIATED TOWARD STREET IMPROVEMENTS.
